HOUSE CONCURRENT RESOLUTION 104

(By Delegates Rowan, Graves, Lovejoy, Pyles and Sypolt )

Requesting study of child custody models that various states have adopted.

Whereas, West Virginia’s current custody laws provide for the best interest of the child.

Whereas, Other states have adopted a presumption that shared parenting is in the best interest of the child;

Whereas, The intensity and quality of parental care significantly impacts a child’s welfare.

Whereas, Many studies have been performed on this issues which should be reviewed and considered by the West Virginia Legislature.

Resolved by the Legislature of West Virginia:

That the West Virginia House of Delegates conduct a study of child custody models to better understand and facilitate child custody laws in the state of West Virginia.

Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2020, on its findings, conclusions, and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

Further Resolved, That the expenses necessary to conduct a study, prepare reports, and draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
