AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2912.05; relating to the Arizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2912.05, to read:

START_STATUTE36-2912.05.  Healthcare group; employer groups; continued eligibility

A.  Notwithstanding section 36-2912, subsection B, if an employer group of two or more eligible employees is enrolled in healthcare group and subsequently becomes an employer group of one eligible employee, the employer group may continue to be enrolled in healthcare group if the employer group continues to meet all other applicable requirements for enrollment pursuant to section 36-2912.

B.  Notwithstanding section 36-2912, subsection B, an employer group of one that was enrolled in healthcare group before September 26, 2008 may continue to be enrolled in healthcare group regardless of all subsequent fluctuations in the number of employees if the employer group remains between one and fifty eligible employees and continues to meet all other applicable requirements for enrollment. Sec. 2.  Retroactivity

This act is effective retroactively to September 26, 2008.
