HOUSE BILL 2142

 

 

 

 

An Act

 

establishing the move over law study committee.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Move over law study committee; membership; duties; report; delayed repeal

A. The move over law study committee is established consisting of the following members:

1. Two members of the senate who are appointed by the president of the senate and who are from different political parties. The president of the senate shall designate one of these members to serve as cochairperson of the committee.

2. Two members of the house of representatives who are appointed by the speaker of the house of representatives and who are from different political parties. The speaker of the house of representatives shall designate one of these members to serve as cochairperson of the committee.

3. The director of the department of transportation or the director's designee.

4. Two members who are appointed by the director of the department of public safety. 

5. One designated towing representative who is appointed by the governor.

B. Committee members are not eligible to receive compensation, but the member who is appointed by the governor is eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2, Arizona Revised Statutes.

C. The committee shall:

1. Conduct a comprehensive study to determine the efficacy of section 28-775, Arizona Revised Statutes, and to determine if additional promotion of the law is needed to ensure its effectiveness.

2. Identify any potential additional resources or policy initiatives that would enhance public safety or could be devoted to improving the efficacy of section 28-775, Arizona Revised Statutes.

3. Propose legislation to address issues identified by the committee.

4. Make policy recommendations to improve safety matters for first responders and citizens and produce policy recommendations relating to safety under section 28-775, Arizona Revised Statutes.

5. On or before December 1, 2024, submit a report regarding the study committee's activities and recommendations for administrative or legislative action to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

D. This section is repealed from and after September 30, 2025.
