An Act

 

amending title 13, chapter 31, Arizona Revised Statutes, by adding section 13-3123; relating to firearms.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 13, chapter 31, Arizona Revised Statutes, is amended by adding section 13-3123, to read:

START_STATUTE13-3123. Unlawful firearm delivery before expiration of mandatory waiting period; exception; classification; definitions

A. It is unlawful for a retailer to deliver a firearm before the expiration of a mandatory waiting period.

B. This section does not apply to law enforcement authorities or licensed private security personnel who require firearms for use in the course and scope of employment.

C. A violation of this section is a class 6 felony.

D. For the purposes of this section:

1. "Mandatory waiting period" means three days after the purchase of a firearm, excluding weekends and legal holidays.

2. "Purchase" means the transfer of money or other valuable consideration to a retailer for a firearm.

3. "Retailer" means a licensed importer, licensed manufacturer or licensed dealer that is engaged in the business of making firearm sales at retail or making firearms available for distribution, use, consumption or storage in this state. END_STATUTE
