AN ACT

 

amending title 41, chapter 7, article 8.1, Arizona Revised Statutes, by adding section 41‑1234; relating to lobbyists.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 7, article 8.1, Arizona Revised Statutes, is amended by adding section 41-1234, to read:

START_STATUTE41-1234.  Lobbyist; designated public lobbyist; authorized public lobbyist; providing false information; prohibition from future registration; violation; classification; civil penalty

A.  A lobbyist, designated public lobbyist or authorized public lobbyist shall not provide information to any public official as to any material fact pertaining to any legislative or administrative action knowing or having reason to know that the information is false.

B.  A lobbyist, designated public lobbyist or authorized public lobbyist who is convicted of violating any provision of this article is prohibited from acting as a lobbyist, designated public lobbyist or authorized public lobbyist for a period of three years after the date of the conviction.

C.  A person who violates this section is guilty of a class 1 misdemeanor and is subject to a civil penalty in an amount equal to the total amount of compensation paid to the lobbyist, designated public lobbyist or authorized public lobbyist by the principal or public body on whose behalf the false information was provided.  The secretary of state shall assess and collect the civil penalty.  Civil penalties shall be deposited in the state general fund.
