AN ACT

 

amending title 12, chapter 5, article 3, Arizona Revised Statutes, by adding section 12-557; relating to personal actions.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 12, chapter 5, article 3, Arizona Revised Statutes, is amended by adding section 12-557, to read:

START_STATUTE12-557.  Claims for medical expenses; recovery of reasonable medical expenses; definitions

A.  In any claim to recover medical expenses incurred as a result of bodily injury or wrongful death, the claimant is entitled to recover reasonable medical expenses, except that If no payments were made by the claimant or on the claimant's behalf, the claimant shall recover the usual and ordinary value of the reasonable and necessary medical expenses for which the claimant is obligated.

B.  For the purposes of this section:

1.  "Claim" means any legal proceeding, underinsured and uninsured motorist proceeding, arbitration or other similar proceeding in which the recovery of medical expenses for bodily injury or wrongful death is permitted.

2.  "Reasonable medical expenses" means the expenses for which monies were actually paid by the claimant, the claimant's health insurance company or any other collateral source in full satisfaction of the services rendered, including any amount owed by the claimant for coinsurance or a copayment or deductible.END_STATUTE

Sec. 2.  Effective date

This act is effective from and after December 31, 2012.
