AN ACT
amending sections 31-284 and 41-1609.03, Arizona Revised Statutes; relating to the state department of corrections.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 31-284, Arizona Revised Statutes, is amended to read:
31-284. Transition program fund
The transition program fund is established consisting of the monies collected pursuant to section 31‑254, subsection D, paragraph 3 and subsection E, paragraph 3 and section 41-1609.03. The department shall administer the fund to pay for any costs related to the administration of the transition program and for transition program services. Monies in the fund are subject to legislative appropriation and are exempt from the provisions of section 35‑190 relating to lapsing of appropriations.
Sec. 2. Section 41-1609.03, Arizona Revised Statutes, is amended to read:
41-1609.03. Adult incarceration private contractors; liability for services; notification of malfunctioning security monitoring system; civil penalty
A private contractor that contracts with any governmental entity to provide detention or incarceration services for offenders shall:
1. Be liable for the cost of any emergency, public safety or security services provided to the contractor by the state or any political subdivision of the state and shall reimburse the state or any political subdivision of the state for the cost of any such services.
2. Immediately notify the director of the state department of corrections that an electronic security system under the contractor's control is malfunctioning or is damaged. The director shall assess a civil penalty of ten thousand dollars per day for each day that a private contractor fails to provide the notification required by this paragraph. The department shall deposit, pursuant to sections 35‑146 and 35‑147, all monies collected pursuant to this paragraph in the transition program fund established by section 31-284.
