A CONCURRENT RESOLUTION

 

proposing an amendment to the constitution of Arizona; amending article II, section 8, constitution of arizona; relating to the right to privacy.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article II, section 8, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE8.  Right to privacy; no unreasonable search or seizure

Section 8.  A.  No person shall be disturbed in his private affairs, or his home invaded, without authority of law.

B.  No person shall be subject to an unreasonable search or seizure, including of the person's home, papers and electronic communications or data.

C.  No warrant to search a place, seize a person or thing or access electronic communication or data shall be issued without all of the following:

1.  A description of the place to be searched, the person or thing to be seized or the electronic communication or data to be accessed.

2.  Probable cause.

3.  Support by written oath or affirmation.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
