A CONCURRENT RESOLUTION

 

Proposing amendments to the Constitution of Arizona; repealing article XIX, Constitution of Arizona, as amended by proposition 101 and as amended by proposition 107, election of November 3, 1992; Amending CONSTITUTION of Arizona, by adding a new article XIX; relating to agriculture and natural resources.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article XIX, Constitution of Arizona, as amended by Proposition 101 and by Proposition 107, election of November 3, 1992, is proposed to be repealed as follows if approved by the voters and on proclamation of the Governor:

Article XIX, Constitution of Arizona, as amended by Proposition 101 and by Proposition 107, election of November 3, 1992, relating to the office of mine inspector, is repealed.

2.  A new article XIX, Constitution of Arizona, is proposed to be added as follows if approved by the voters and on proclamation of the Governor:

ARTICLE XIX.  SECRETARY OF AGRICULTURE AND NATURAL RESOURCES

1.  Secretary of agriculture and natural resources

Section 1.  A.  The office of secretary of agriculture and natural resources is established as an office in the executive department of government.

B.  The secretary shall be elected initially at the regular general election in 2014 and hold office for a term of four years beginning on the first Monday in January, 2015.  The secretary shall not hold that office for more than two consecutive terms, including any part of a term served.  After serving two consecutive terms, no person serving as secretary may hold that office again until out of office for at least one full term.

C.  The candidate for secretary receiving the highest number of the votes cast for the office shall be elected, but if two or more persons receive the same and the highest number of votes for the office, the two houses of the legislature at its next regular session shall elect forthwith, by joint ballot, one of those candidates to office.

D.  During the term of office, the secretary shall reside and maintain the office and the public records, books and papers at the seat of government.

E.  The secretary is responsible for exercising the powers and duties assigned by law relating to the state management and administration of:

1.  Agriculture and livestock.

2.  Water management, including dam safety.

3.  Environmental quality, including water quality, air quality and solid, liquid, hazardous and radioactive waste.

4.  The administration of state lands as state land commissioner under article X, including the management and sale of the products of state lands.

5.  Mine safety and mineral, oil and gas resources.

6.  Wildlife, including game animals, birds and fish.

7.  Other natural resources as provided by law.

3.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
