A RESOLUTION
EXPELLING DANIEL PATTERSON FROM THE HOUSE OF REPRESENTATIVES.

Whereas, an ethics complaint was filed on February 27, 2012 concerning Representative Daniel Patterson; and
Whereas, the House of Representatives retained special counsel to conduct an independent investigation; and
Whereas, the special counsel filed an investigative report on March 30, 2012 that demonstrated cause for the expulsion of Representative Patterson; and
Whereas, the Committee on Ethics reported on April 11, 2012 that it found substantial evidence that Representative Patterson has engaged in a pattern of ethical misconduct involving disorderly, aggressive, unprofessional, counterproductive, intimidating and disrespectful conduct interfering with the proper and efficient accomplishment of legislative business; and
Whereas, Representative Patterson has violated House Rule 1, relating to disorderly behavior, and other rules and customs of the House of Representatives regarding decorum, debate, voting and minimum standards of honesty and respect for other members and the public; and
Whereas, there are grave questions as to whether Representative Patterson has engaged in violent and unlawful conduct on more than one occasion outside of the halls of the House of Representatives, while serving as an elected member of the same; and
Whereas, the Committee on Ethics recommended to the House of Representatives that Representative Patterson be expelled for disorderly behavior under Article IV, part 2, section 11, Constitution of Arizona.
Therefore
Be it resolved by the House of Representatives of the State of Arizona:
1. That the report and recommendation of the Committee on Ethics are adopted and incorporated into this resolution.
2. That in the exercise of the power granted to it by Article IV, part 2, section 11, Constitution of Arizona, the House of Representatives, with the concurrence of two-thirds of its members, hereby expels member Daniel Patterson.
3. That the seat of the member of the House of Representatives, legislative district 29, occupied by Daniel Patterson is now vacant.
