AN ACT

 

amending sections 11‑201 and 11-401, Arizona Revised Statutes; relating to county officers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 11-201, Arizona Revised Statutes, is amended to read:

START_STATUTE11-201.  Powers of county

A.  The powers of a county shall be exercised only by the board of supervisors or by agents and officers acting under its authority and authority of law.  It has the power to:

1.  Sue and be sued.

2.  Purchase and hold lands within its limits.

3.  Make such contracts and purchase and hold such personal property as may be necessary to the exercise of its powers.

4.  Make such orders for the disposition or use of its property as the interests of the inhabitants of the county require.

5.  Levy and collect taxes for purposes under its exclusive jurisdiction as are authorized by law.

6.  Determine the budgets of all elected and appointed county officers enumerated under section 11-401 by action of the board of supervisors.  The monies appropriated by action of the board of supervisors pursuant to this paragraph shall be in a lump sum.

B.  Except for the purposes of acting as an intermediary in a license transfer or sale, a county shall not own a commercial cable television system or any other pay television system.

C.  Section 11-251.05, subsection A, paragraph 1 does not authorize a county to levy and collect taxes for any purposes beyond those otherwise specifically authorized by statute. END_STATUTE

Sec. 2.  Section 11-401, Arizona Revised Statutes, is amended to read:

START_STATUTE11-401.  Enumeration of officers; authority of elected county officers

A.  The officers of the county are:

1.  Sheriff.

2.  Recorder.

3.  Treasurer.

4.  School superintendent.

5.  County attorney.

6.  Assessor.

7.  Supervisors.

8.  Clerk of the board of supervisors.

9.  Tax collector.

10.  Justices of the peace.

B.  The county treasurer shall be ex officio tax collector.

C.  An elected county officer has the full authority and discretion to choose the appropriate means to accomplish the statutory duties of the office as provided by the constitution and statutes of this state.  All necessary or implied power or authority of a county office is reserved to each elected county officer.  Subject to applicable statutes, these powers and authorities include:

1.  The delivery of services.

2.  The organization of the office, including allocating available monies to purchase goods and property determined by the elected county officer to be necessary or appropriate to further the functions of the office.

3.  The hiring, assignment and control of personnel in the county office, including salary, subject to available funding and applicable county employee merit system requirements.

4.  The establishment of standards and required experience for positions within the county office.

5.  Entering into agreements or contracts that further the functions of the office. END_STATUTE
