AN ACT

 

amending title 16, chapter 6, article 2, Arizona Revised Statutes, by adding section 16-956.01; relating to the CITIZENS clean elections commission.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 16, chapter 6, article 2, Arizona Revised Statutes, is amended by adding section 16-956.01, to read:

START_STATUTE16-956.01.  Random audits; corporate, limited liability company and labor organization independent expenditures; procedure

A.  After each general election, the commission shall conduct random audits from among those corporations, limited liability companies or labor organizations that register pursuant to section 16‑914.02 and make independent expenditures in that election cycle.  Random audits shall be conducted in accordance with procedures established by the commission and shall include the review of notifications, related documentation and other financial records to determine whether the corporation, limited liability company or labor organization is in compliance with section 16‑914.02, subsection K.

B.  The Commission may hire an independent accounting firm to conduct the random audits.  The selection of any corporation, limited liability company or labor organization for audit shall be determined by random lot at a commission meeting.  The audit is confidential unless a finding is made that a violation has occurred, in which case the commission shall notify the appropriate filing officer of the alleged violation. Sec. 2.  Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, section 16-956.01, Arizona Revised Statutes, as added by this act, is effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
