AN ACT

 

Amending title 25, chapter 4, article 1, Arizona Revised Statutes, by adding section 25-416; relating to child custody.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 25, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 25-416, to read:

START_STATUTE25-416.  De facto caregivers; disclosure requirements; exemption; civil penalty; definition

A.  A parent of a minor child may submit a written request pursuant to this section for correct identifying information regarding each of the child's de facto caregivers.  The information must include all true, assumed and "also known as" names and copies of any current state or federal identification documents. 

B.  Within thirty days after receiving a written request from the parent of a minor child, the recipient must provide the parent with either the information prescribed in subsection A of this section or a written response that states the reasons the person does not meet the definition of a de facto caregiver.

C.  If a minor child's parents are not residing together, on written request a parent must submit to the other parent within thirty days after receipt of the request the name and contact information of each de facto caregiver.

D.  A request made pursuant to this section must include a copy of this section.

E.  A parent requesting information pursuant to this section is responsible for costs associated with that request.

F.  The following are exempt from the disclosure requirements of this section:

1.  Employees and staff members of the minor child's school or state licensed child care facility.

2.  Employees and staff members of properly licensed businesses that may provide child care services for brief periods, such as retail stores and health clubs.

G.  A person who violates this section is subject to a civil penalty of five-hundred dollars.

H.  For the purposes of this section, "de facto caregiver" means a person who is at least eighteen years of age and who meets any of the following:

1.  Supervises the parent's minor child for more than four hours each week.

2.  Is domiciled in the same residence with the parent's minor child, either on a part-time or full-time basis.

3.  Is in such proximity to the parent's minor child as to create a tangent relationship for more than eight hours each week. END_STATUTE
