AN ACT

 

amending title 13, chapter 38, article 7, Arizona Revised Statutes, by adding section 13-3907; relating to arrest.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 13, chapter 38, article 7, Arizona Revised Statutes, is amended by adding section 13-3907, to read:

START_STATUTE13-3907.  Child care phone calls for arrested custodial parents; notification; classification

A.  As soon as practicable but not more than three hours after a person is arrested and is brought to a law enforcement agency for incarceration, the arresting officer or booking agency shall inquire if the person is a custodial parent with responsibility for a minor child.  The arresting officer or booking agency shall notify the arrested person who is a custodial parent with responsibility for a minor child that the person is entitled to and may request to make two completed telephone calls to a relative or other person to arrange for the care of the minor child or children in the parent's absence.  The telephone calls shall be at no expense to the arrested person if the telephone calls are completed to telephone numbers within the local calling area, or at the arrested person's expense if the telephone calls are completed outside the local calling area.  The telephone calls shall be allowed immediately on request or as soon as practicable.

B.  At any law enforcement agency or place where an arrested person is detained, a sign that contains the following information in bold block type shall be posted in a conspicuous place:

"The arrested person, if the arrested person is a custodial parent with responsibility for a minor child, has the right to two telephone calls to arrange for the care of the minor child or children in the parent's absence.  Telephone calls within the local calling area are at no expense, or are at the arrested person's own expense if outside the local calling area."

C.  The sign posted pursuant to subsection B of this section shall be in English and any non-English language that is spoken by a substantial number of the public who are served by the law enforcement agency or place of detainment.

D.  This section does not abrogate a law enforcement officer's duty to advise a suspect of the suspect's right to counsel or of any other right.

E.  Any public officer or employee who knowingly deprives an arrested person of any right granted by this section is guilty of a class 3 misdemeanor. END_STATUTE
