AN ACT

 

Amending title 36, chapter 6, Arizona Revised Statutes, by adding article 15; relating to the influenza vaccination.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 6, Arizona Revised Statutes, is amended by adding article 15, to read:

ARTICLE 15.  INFLUENZA VACCINATIONS

START_STATUTE36-799.  Patient assessment; influenza vaccinations; committee of reference review

A.  If the centers for medicare and medicaid services hospital inpatient quality reporting and hospital value‑based purchasing programs retire the offering of the influenza vaccination and assessing the status of patients who are at least sixty‑five years of age from the timely and effective care measure set, the appropriate legislative committee of reference may consider whether a change in state law or rule to continue to require hospitals to assess patients who are at least sixty-five years of age and to offer the influenza vaccination is in the best interest of the public health.

B.  Before the introduction of legislation to require hospitals to assess patients who are at least sixty‑five years of age and to offer the influenza vaccination, the appropriate legislative committee of reference shall consider whether this change in state law or rule is in the best interest of the public health.END_STATUTE
