AN ACT

 

amending Title 15, chapter 1, article 8, Arizona Revised Statutes, by adding section 15-187.02; relating to charter schools.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 8, Arizona Revised Statutes, is amended by adding section 15-187.02, to read:

START_STATUTE15-187.02.  Charter schools; teachers; evaluations; confidentiality

Copies of the assessment and evaluation report and performance classification prescribed in section 15-203, subsection a, paragraph 38 of a teacher that are retained by the charter school governing body, charter holder, charter school sponsor and department of education are confidential, do not constitute a public record and shall not be released or shown to any person except:

1.  To the charter school teacher who may make any use of it.

2.  To authorized officers and employees of the charter school, charter holder or charter school sponsor for all personnel matters regarding employment and contracts and for any hearing that relates to personnel matters.

3.  To school districts and charter schools that inquire about the performance of the teacher for employment purposes.

4.  For introduction in evidence or discovery in any court action between the teacher and the charter school, the charter holder or the charter school sponsor in which either:

(a)  The competency of the teacher is at issue.

(b)  The evaluation and performance classification was an exhibit at a hearing, the result of which is being challenged.END_STATUTE
