AN ACT

 

amending Title 38, chapter 3, article 4, Arizona Revised Statutes, by adding section 38‑450; relating to public events.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 38, chapter 3, article 4, Arizona Revised Statutes, is amended by adding section 38‑450, to read:

START_STATUTE38-450.  Public events; permit; risk management; definition

A.  A person may not conduct a public event on property under the control of a public institution unless the person has been issued a public event permit by the public institution pursuant to this section.

B.  As a condition of the public event permit, The public institution shall require that the public event be conducted:

1.  In a manner that minimizes damage to public property and facilities, protects members of the general public and minimizes disruption of government operations.

2.  In compliance with federal, state and local laws, ordinances, rules and regulations.

C.  A public institution shall not issue a public event permit unless the person seeking the permit, at a minimum, provides to the public institution:

1.  A deposit, in an amount prescribed by the public institution, for damage and clean-up expenses incurred by the public institution as a result of the public event.

2.  Evidence of liability insurance for the public event, in an amount prescribed by the risk management section of the department of administration, that names the public institution as an additional insured.

D.  For the purposes of this section, "public event" means picketing, protesting, speechmaking, marching or conducting a vigil, religious service, press conference, luncheon, celebration, entertainment, exhibition, parade, fair, pageant or any other activity that involves the communication or expression of views or ideas by one or more persons.
