AN ACT
amending title 28, chapter 3, article 15, Arizona Revised Statutes, by adding section 28-913; relating to smoking in motor vehicles.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 28, chapter 3, article 15, Arizona Revised Statutes, is amended by adding section 28-913, to read:
28-913. Smoking in motor vehicle with minor prohibited; civil penalties
A. A person shall not smoke in a motor vehicle if a person under sixteen years of age is in the motor vehicle.
B. If a law enforcement officer stops a motor vehicle for an apparent violation of this section, the officer shall determine whether anyone in the motor vehicle is under sixteen years of age.
C. A law enforcement officer shall not stop or issue a citation to a person operating a motor vehicle on a highway in this state for a violation of this section unless the law enforcement officer has reasonable cause to believe there is another alleged violation of a motor vehicle law of this state.
D. For a first violation, a person is subject to a civil penalty of fifty dollars for each person who is under sixteen years of age and who is in the motor vehicle. For each subsequent violation, the civil penalty shall be one hundred dollars for each person who is under sixteen years of age and who is in the motor vehicle.
E. A person who violates this section is responsible for a nonmoving civil traffic violation.
