An act to add Chapter 8.8 (commencing with Section 44269) to Part 5 of Division 26 of the Health and Safety Code, relating to vehicular air pollution.

Existing law establishes the Alternative and Renewable Fuel and Vehicle Technology Program, administered by the State Energy Resources Conservation and Development Commission. Existing law requires the commission under the Alternative and Renewable Fuel and Vehicle Technology Program to provide funding measures to certain entities to develop and deploy innovative technologies that transform California’s fuel and vehicle types to help attain the state’s climate change policies. Existing law requires the commission to give preference to those projects that maximize the goals of the program based on specified criteria and to fund specified eligible projects, including, among others, alternative and renewable fuel projects to develop and improve alternative and renewable low-carbon fuels, including renewable diesel.
This bill would require the State Air Resources Board, by July 1, 2021, to adopt the Clean Fleet Program to reduce the emissions of greenhouse gases, to improve air quality, and to benefit low-income residents by providing certain incentives for the displacement of petroleum diesel with biofuels, as defined, The bill would require the state board to adopt guidelines for the program and to begin the implementation of the program on January 1, 2022. The bill would require the state board, on July 1, 2021, and every fiscal year thereafter, to set specific and measurable goals for the displacement of petroleum fuel with biofuels.

The people of the State of California do enact as follows:


SECTION 1.

 Chapter 8.8 (commencing with Section 44269) is added to Part 5 of Division 26 of the Health and Safety Code, to read:
CHAPTER  8.8. Clean Fleet Program

44269.
 For purposes of this chapter, “biofuels” means a fuel developed from converting biomass into a liquid fuel.

44269.1.
 (a) On or before July 1, 2021, the state board shall adopt the Clean Fleet Program that focuses on achieving reductions in emissions of greenhouse gases, improving air quality, and benefiting low-income residents of the state through the displacement of petroleum diesel with cleaner and more efficient biofuels by providing incentives set forth in subdivision (b) for the displacement of petroleum diesel with biofuels. The state board shall begin implementation of the program beginning January 1, 2022.
(b) The program shall provide incentives as follows:
(1) For off-road uses, at least twenty-five cents ($0.25) for each gallon of petroleum diesel displaced by biofuels.
(2) For on-road uses, at least ten cents ($0.10) for each gallon of petroleum diesel displaced by biofuels for fleets with at least 25 trucks.
(c) The state board shall adopt guidelines for the implementation of the program that ensure all of the following:
(1) The program is focused on areas that will provide the greatest air quality impact.
(2) The program provides for improved coordination, integration, and partnership with other programs that target disadvantaged communities and receive moneys from the Greenhouse Gas Reduction Fund.
(3) The program provides for enhanced prescreening of applicants to the program, if determined appropriate by the state board.

44269.2.
 (a) On or before July 1, 2021, and every fiscal year thereafter, the state board shall set specific and measurable goals for the displacement of petroleum diesel with biofuels.
(b) The state board shall take all necessary steps to meet the goals set forth in subdivision (a).
