An act to add Section 5170 to the Vehicle Code, relating to vehicles.

Existing law permits state agencies to apply to the Department of Motor Vehicles to sponsor a specialized license plate program. The department may establish a program when specified requirements are met, such as receiving 7,500 applications for the agency’s specialized license plates. Existing law requires fees in addition to regular license plate fees to be paid for registration and renewal of specialized license plates, as specified. Existing law establishes the Enhanced Fleet Modernization Subaccount to make moneys available, upon appropriation by the Legislature, to achieve the goals of the Enhanced Fleet Modernization Program, including achieving reductions in the emissions of greenhouse gases, improvements in air quality, and benefits to low-income residents through the replacement of high-polluter motor vehicles with cleaner and more efficient motor vehicles.

This bill would authorize a state agency to apply to the department to sponsor a Go Green specialized license plate program. Go Green specialized license plates would only be available for zero-emission vehicles. This bill would require the Department to deposit revenue generated by the Go Green specialized license plate program, after administrative costs have been deducted, in the Enhanced Fleet Modernization Subaccount to help provide additional funding for the retirement of older polluting vehicles and incentivize the purchase of new and used zero-emission vehicles.

The people of the State of California do enact as follows:

SECTION 1.

Section 5170 is added to the Vehicle Code, to read:

5170.

(a) A state agency may apply to the department, pursuant to Section 5156, to sponsor a Go Green specialized license plate program. The department shall issue specialized license plates for that program if the state agency complies with the requirements of Section 5156.

(b) The department shall only issue Go Green specialized license plates to zero-emission vehicles.

(c) The fees specified in Section 5157 shall be imposed for the issuance, renewal, or transfer of specialized license plates authorized by this section. Notwithstanding subdivision (c) of Section 5157, after deducting its administrative costs, the department shall deposit the revenue derived from the additional fees to the Enhanced Fleet Modernization Subaccount, created pursuant to Section 44126 of the Health and Safety Code, to help provide additional funding for the retirement of older polluting vehicles and incentivize the purchase of new and used zero-emission vehicles.

(d) It is the intent of the Legislature that the department, in consultation with the requesting state agency, will design and make available for issuance pursuant to this article Go Green license plates. Specifically, it is the intent of the Legislature that the license plates issued pursuant to this section consist of a green background with a message, such as “Go Green to Clean our Climate,” below the numerical series.
