AN ACT REGULATING THE GROWTH AND SALE OF GOLDEN BAMBOO.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2012) (a) No person who plants golden bamboo (Phyllostachys aurea) on his or her property shall permit such golden bamboo to grow beyond the boundaries of such property. Any person who violates this subsection shall be fined not more than ____ dollars.

(b) Any retailer shall provide to any purchaser of golden bamboo a disclosure stating that golden bamboo is a fast growing plant that may spread if not contained, and that it is unlawful for a person who plants golden bamboo to permit such golden bamboo to grow beyond the boundaries of his or her property.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To make it unlawful for a person planting golden bamboo to allow such bamboo to spread onto a neighbor's property, and to require retailers of golden bamboo to provide purchasers with notice of this law.
