AN ACT CONCERNING AWARDS OF NONECONOMIC DAMAGES IN MEDICAL MALPRACTICE ACTIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-572h of the general statutes be amended to limit recovery of noneconomic damages resulting from personal injury or wrongful death, whether in tort or in contract, when it is alleged that such injury or death resulted from the professional negligence of a health care provider or health care institution, or both, in the medical diagnosis, care or treatment of the claimant, to not more than (1) two hundred fifty thousand dollars for each health care provider per event, (2) two hundred fifty thousand dollars for each health care institution per event, and (3) seven hundred fifty thousand dollars overall for each event.

Statement of Purpose:

To limit awards of noneconomic damages in medical malpractice actions.
