AN ACT CONCERNING THE COLLECTION OF DATA REGARDING RECIPIENTS OF SOCIAL SERVICE PROGRAM BENEFITS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective January 1, 2015) (a) The Department of Public Health, the Department of Social Services and any other office or agency of the state that collects primary data concerning the identity of persons served by such department, office or agency shall collect and maintain data aggregated in a manner that does not identify such persons, concerning such persons' race, ethnicity, sex, sexual orientation, gender identity, primary language and disability status. Such department, office or agency may collect additional data, including, but not limited to, the residential address, socioeconomic status and level of acculturation of such persons. Any such data shall be collected by such departments, office or agency using a self-reporting method, except a parent or guardian may report such information by responding to questions on behalf of a minor and a guardian or conservator may report such information by responding to questions on behalf of a person who is incapacitated.

(b) Said departments, office or agency shall annually review data collected in accordance with subsection (a) of this section. Such review shall include, but need not be limited to, an assessment of the race, ethnicity, sex, sexual orientation, gender identity, primary language, disability status, and, if such data is collected, socioeconomic status or other identifying information of the population group served by such department, office or agency. If such department, office or agency is not able to collect sufficient data in accordance with subsection (a) of this section to enable such department, office or agency to conduct an analysis of such data, such department, office or agency shall establish and implement a plan to improve such data collection. Such plan may include identification of barriers to effective data collection, a plan for overcoming such barriers and a timeline for achieving effective data collection in accordance with subsection (a) of this section.

This act shall take effect as follows and shall amend the following sections:
