AN ACT REQUIRING A STUDY OF OFFSETS IN LONG-TERM DISABILITY INCOME PROTECTION POLICIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) On or before January 1, 2012, the Legislative Program Review and Investigations Committee shall submit to the joint standing committee of the General Assembly having cognizance of matters relating to insurance a study of offsets contained in individual and group long-term disability income protection policies offered to residents of the state. Such study shall include, but not be limited to, an examination of (1) specific benefits for which such offsets limit payments to an insured, (2) the average percentage of income such policies cover and maximum dollar limits of such policies, (3) differences in costs to an insured for policies that contain an offset and comparable policies that do not contain an offset, (4) the potential impact on market penetration of any changes to offsets contained in long-term disability income protection policies, (5) the potential impact on state assistance programs, including, but not limited to, the Medicaid program and the state supplement program to the Supplemental Security Income Program of any changes to offsets contained in such policies, and (6) the financial impact on state employee benefits of any changes to offsets contained in such policies.

This act shall take effect as follows and shall amend the following sections:
