AN ACT CONCERNING THE CLAIMS AGAINST THE STATE OF SARAH DEMARIA AND PAUL DEMARIA.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to permit Sarah DeMaria and Paul DeMaria to present their respective claims against the state relating to alleged negligence or omissions of state employees or agents in misdiagnosing the terminal illness that afflicts Sarah DeMaria.

Statement of Purpose:

To permit Sarah DeMaria and Paul DeMaria to present their claims against the state to the Claims Commissioner for a hearing on the merits of such claim, as their failure to timely file with the Claims Commissioner was caused by the alleged negligence or omissions on the part of the State of Connecticut, namely, that agents, servants or employees of the state misdiagnosed Sarah DeMaria's 2010 biopsy, thereby failing to discover or notify the claimants that the material biopsied was early stage mesothelioma.
