AN ACT CONCERNING WAITING LISTS FOR PUBLIC HOUSING.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 8-37ee of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2014):

(a) Each entity participating in any program administered by a housing agency, as defined in section 8-37aa, under this title shall have an affirmative duty to promote fair housing in each housing development that is assisted or supervised under any provision of this title.

(b) Any entity applying for financial assistance under any program administered by a housing agency established by this title shall submit an affirmative fair housing marketing plan to such housing agency for its approval. Such plan shall have provisions for recruitment of an applicant pool that includes residents of municipalities [of] with relatively high concentrations of minority populations. The housing agency shall periodically review each plan to assure that to the extent practicable such an applicant pool is created and may require that a plan be revised by the entity submitting it.

(c) Not later than January 1, 2016, the Department of Housing shall, by regulation adopted in accordance with the provisions of chapter 54, develop waiting list guidelines for use in conjunction with affirmative fair housing marketing plans. Such guidelines shall require any entity applying for or participating in programs assisted or supervised by state housing agencies: (1) To offer housing based on a random lottery process for the first thirty days after the date on which such housing initially becomes available; and (2) after such initial lottery period has passed, to offer housing on a first-come, first-served basis that allows for income tiering.

This act shall take effect as follows and shall amend the following sections:
