AN ACT CONCERNING LIVERY SERVICE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subparagraph (JJ) of subdivision (37) of subsection (a) of section 12-407 of the 2012 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2012, and applicable to sales occurring on or after said date):

(JJ) Intrastate transportation services provided by livery services, including limousines, community cars, taxicabs, motor busses or vans, with a driver, provided such services provided by a motor bus or taxicab shall be taxable only if such service originates or terminates outside the territory specified in such motor bus or taxicab's certificate of public convenience and necessity. Intrastate transportation services shall not include transportation by [taxicab, motor bus,] ambulance or ambulette, scheduled public transportation, nonemergency medical transportation provided under the Medicaid program, paratransit services provided by agreement or arrangement with the state or any political subdivision of the state, dial-a-ride services or services provided in connection with funerals, and shall not include transportation by taxicab or motor bus, when such services provided by a taxicab or motor bus originate and terminate within the territory specified in such taxicab or motor bus's certificate of public convenience and necessity;

This act shall take effect as follows and shall amend the following sections:
Section 1	July 1, 2012, and applicable to sales occurring on or after said date	12-407(a)(37)(JJ)

Statement of Purpose:

To equalize the taxation of for-profit transportation services.
