AN ACT CONCERNING THE IMPOSITION OF SANCTIONS AND FINES ON PRINCIPALS WHO FAIL TO REPORT A PHYSICAL ASSAULT ON SCHOOL EMPLOYEES BY A STUDENT, A CAUSE OF ACTION FOR SCHOOL EMPLOYEES WHO ARE VICTIMS OF A PHYSICAL ASSAULT BY A STUDENT, AND THE IMPOSITION OF SANCTIONS AND FINES ON MANDATED REPORTERS WHO FAIL TO REPORT.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subsection (a) of section 10-233g of the general statutes be amended to impose a fine of not less than five hundred dollars nor more than two thousand five hundred dollars on principals who fail to report a physical assault made by a student upon a teacher or other school employee and require such principal to participate in an educational training program established by the Department of Education; that section 10-236a of the general statutes be amended to permit any teacher or school employee who has been the victim of a physical assault made by a student to bring a civil action in the Superior Court for the payment of back wages, employee benefits or other financial loss and expense incurred as a result of such assault and permit any such teacher or school employee to file a complaint with the chairman of the Workers' Compensation Commission for the payment of back wages, employee benefits or other financial loss and expense incurred as a result of such assault; and that section 17a-101a of the general statutes be amended to impose a fine of not less than five hundred dollars nor more than two thousand five hundred dollars on any mandated reporter who fails to report a violation of such section and require such mandated reporter to participate in an educational training program established by the Department of Education
Statement of Purpose:
To impose sanctions and fines on principals who fail to report a physical assault on a teacher or school employee by a student, to permit the victim of a physical assault by a student to file a claim in the Superior Court or file a complaint with the chairman of the Workers' Compensation Commission, and to impose sanctions and a fine on a mandated reporter who fails to report as required by law.
