HOUSE BILL NO. 7

AN ACT TO AMEND THE LAWS OF DELAWARE, VOLUME 27, AS AMENDED, RELATING TO THE CHARTER OF THE CITY OF NEW CASTLE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all Members elected to each house thereof concurring therein):


Section 1.Amend the Charter of the City New Castle, Volume 27, Chapter 216, Laws of Delaware, as amended, (hereinafter, the "New Castle City Charter") in the initial Section 5 thereof (i.e., not the Section 5 appearing in the "Comments" section of the New Castle City Charter) by striking the following paragraphs appearing therein in their entirety:

"For the purposes of holding such election(s) the City of New Castle shall be divided into four districts, corresponding within the City to the election districts as laid out under the General Election Laws of the State of Delaware, (15 Del.C. Ch., 1-79), with voting places provided for by said General Election Laws.".

and

"The Board of Elections shall determine the places for holding said election, subject to the approval of City Council, in the several districts and shall give notice of the time and places of holding said election by posting notice thereof in at least three of the most public places in each of the districts of the City at least a week before the day on which said election is to be held, and by publishing notice thereof one (1) time at least one (1) week in advance of said day in a newspaper having general circulation in the City of New Castle.".

Section 2.Further amend the initial Section 5 of the New Castle City Charter by inserting immediately prior to the currently-existing sentence therein that reads "On the day of the election, all polling places will open at 8:00 A.M., local time and close at 6:00 P.M., local time, for the purpose of voting." the following paragraph:

"The Board of Elections shall determine the place or places for holding said election, subject to the approval of City Council, and shall give notice of the time and place or places of holding said election by posting notice thereof in at least twelve of the most public places within the City, and geographically distributed in an even fashion throughout the City, at least a week before the day on which said election is to be held, and by publishing notice thereof one (1) week in advance of said day in a newspaper having general circulation in the City of New Castle.".


SYNOPSIS

This Act is designed to update the New Castle City Charter.The New Castle City Board of Elections met and discussed the charter and the requirement for the City to be divided into four election districts.The City Board of Elections concluded that there is no need for the City to be divided into four election districts, as required in the current charter, for the following reasons:(i) all elected positions run city-wide and representation of all elected officials is at-large and city wide; (ii) the total geographic area of the City is relatively small, only 3.5 square miles; and (iii) elimination of the four election districts will streamline the election process, making it more concise and efficient.Based on the foregoing, New Castle City chose to amend its charter.
