A BILL TO BE ENTITLED
AN ACT


To amend Chapter 60 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions relative to counties and municipal corporations, so as to provide a short title; to provide that no local governing authority shall prohibit the construction of a fence between properties of a sufficient height to prevent a person at the highest point of observation in one residence to observe activity within an adjacent property; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
This Act shall be known and may be cited as the "Child Protection Act."

SECTION 2.
Chapter 60 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions relative to counties and municipal corporations, is amended by adding a new Code section to read as follows:
"36-60-27.
No county, municipality, consolidated government, or local governing authority shall limit the maximum height of a fence or wall to a measurement less than that which is required to prevent a person at the highest point of observation within one residential zoned structure from observing any person or activity in any point within the fenced or walled area of an adjacent residential zoned property."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
