A BILL TO BE ENTITLED
AN ACT


To amend an Act relating to the Montgomery County Board of Education, approved March 21, 1979 (Ga. L. 1979, p. 3151), as amended, so as to change the description of the education districts; to provide for the manner of election; to provide for definitions and inclusions; to provide for the continuation in office of current members; to provide for the submission of this Act for preclearance pursuant to Section 5 of the federal Voting Rights Act of 1965, as amended; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act relating to the Montgomery County Board of Education, approved March 21, 1979 (Ga. L. 1979, p. 3151), as amended, is amended by revising Section 1 of Article II as follows:

"SECTION 1.
(a) For purposes of electing members of the board, the Montgomery County School District is divided into four education districts, and those districts shall be and correspond to those four districts described in and attached to this Act and made a part hereof and further identified as 'Plan: montgomeryccsb-2012 Plan Type: local Administrator: montgomery User: bak'.
(b)(1) For the purposes of such plan:
(A) The term 'VTD' shall mean and describe the same geographical boundaries as provided in the report of the Bureau of the Census for the United States decennial census of 2010 for the State of Georgia. The separate numeric designations in a district description which are underneath a VTD heading shall mean and describe individual Blocks within a VTD as provided in the report of the Bureau of the Census for the United States decennial census of 2010 for the State of Georgia; and
(B) Except as otherwise provided in the description of any district, whenever the description of any district refers to a named city, it shall mean the geographical boundaries of that city as shown on the census maps for the United States decennial census of 2010 for the State of Georgia.
(2) Any part of the Montgomery County School District which is not included in any district described in subsection (a) of this section shall be included within that district contiguous to such part which contains the least population according to the United States decennial census of 2010 for the State of Georgia.
(3) Any part of the Montgomery County School District which is described in subsection (a) of this section as being included in a particular district shall nevertheless not be included within such district if such part is not contiguous to such district. Such noncontiguous part shall instead be included within that district contiguous to such part which contains the least population according to the United States decennial census of 2010 for the State of Georgia."

SECTION 2.
Said Act is further amended by revising Section 2 of Article II as follows:

"SECTION 2.
(a) One commissioner each shall be elected from Commissioner Districts 1, 2, and 4 by the electors of such districts, and two commissioners shall be elected from Commissioner District 3 by the electors of such district. The two commissioners elected from District 3 shall be designated as holding Post 1 and Post 2, respectively.
(b) Any person qualifying as a candidate shall designate the education district for which he or she desires to qualify. A person shall not offer as a candidate for election to the board from any education district other than the education district in which he or she is a legal resident."

SECTION 3.
Said Act is further amended by revising Section 4 of Article II as follows:

"SECTION 4.
(a) Those members of the Board of Education of Montgomery County who are serving as such on the effective date of this section and any person selected to fill a vacancy in any such office shall continue to serve as such members until the regular expiration of their respective terms of office and upon the election and qualification of their respective successors.
(b) On the effective date of this section, the member of the board of education representing former Education District 1 shall be deemed to represent new Education District 1, the member of the board of education representing former Education District 2 shall be deemed to represent new Education District 2, the member of the board of education representing former Education District 3 shall be deemed to represent Post 1 of new Education District 3, the member of the board of education representing former Education District 4 shall be deemed to represent Post 2 of new Education District 3, and the member of the board representing former Education District 5 shall be deemed to represent new Education District 4.
(c) At the general election in 2012, successors shall be elected to those members representing new Education Districts 1 and 2 and Education District 3, Post 1. Such successors shall take office on January 1 following such election for a term of four years and until their respective successors are elected and qualified. At the general election in 2014, successors shall be elected to those members representing new Education District 3, Post 2, and Education District 4. Such successors shall take office on January 1 following such election for a term of four years and until their respective successors are elected and qualified.
(d) Thereafter, successors to all members shall be elected to terms of four years and until their respective successors are elected and qualified. Successors shall be elected in the general election in the year in which their respective terms of office expire and shall take office on the first day of January immediately following their election."

SECTION 4.
The Board of Education of Montgomery County shall through its legal counsel cause this Act to be submitted for preclearance under Section 5 of the federal Voting Rights Act of 1965, as amended, not later than 45 days after the date on which this Act is approved by the Governor or otherwise becomes law without such approval.

SECTION 5.
All laws and parts of laws in conflict with this Act are repealed.
