A BILL TO BE ENTITLED
AN ACT


To amend Code Section 44-3-76 of the Official Code of Georgia Annotated, relating to compliance with condominium instruments, rules, and regulations, so as to prevent an association from prohibiting the display of a for sale sign by a unit owner; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 44-3-76 of the Official Code of Georgia Annotated, relating to compliance with condominium instruments, rules, and regulations, is revised by designating the existing language as subsection (a) and adding a new subsection to read as follows:
"(b) Notwithstanding the provisions of subsection (a) of this Code section, no association shall prohibit a unit owner and all those entitled to occupy a unit from displaying a for sale sign within the unit, regardless of whether all of the units in the condominium complex have been sold. Nothing in this subsection shall be construed to prohibit the association from proscribing the type and design of the sign, so long as such requirements are reasonable."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
