BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 40-14-1 of the Official Code of Georgia Annotated, relating
to definitions pertaining to use of speed detection devices, so as to clarify
the definition of speed detection device; to clarify that speed detection device
shall not include a speed detection monitoring device; to provide for related
matters; to repeal conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 40-14-1 of the Official Code of Georgia Annotated, relating to
definitions pertaining to use of speed detection devices, is amended by revising
paragraph (4) as follows:
"(4)
'Speed detection device' means, unless otherwise indicated, that particular
device designed to measure the speed or velocity of a motor vehicle and marketed
under the name 'Vascar' or any similar device operating under the same or
similar principle and any devices for the measurement of speed or velocity based
upon the Doppler principle of radar or the speed timing principle of laser. All
such devices must meet or exceed the minimum performance specifications
established by the Department of Public Safety.
Speed
detection device shall not include any speed detection monitoring device that
produces recorded images of motor vehicles being operated in disregard or
disobedience of posted speed limits. Nothing contained in this article shall be
construed as authorizing the use of a speed detection monitoring device by a law
enforcement agency, nor shall any recorded image from such a device be a basis
for a conviction or civil
penalty."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
