A BILL TO BE ENTITLED
AN ACT


To amend Code Section 12-8-40.1 of the Official Code of Georgia Annotated, relating to tire disposal restrictions, so as to provide that certain persons transporting scrap tires shall only be paid after delivery is complete; to provide for procedures; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 12-8-40.1 of the Official Code of Georgia Annotated, relating to tire disposal restrictions, is amended by adding a new subsection to read as follows:
"(e.1) If the person transporting scrap tires for processing or disposal is not the generator, such person shall not be compensated for such services until delivery to the final destination is complete, as evidenced by a scrap tire manifest bearing the generator's identification number and signed and dated by the receiver. The generator shall maintain records of all such deliveries for a period of at least three years."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
