A BILL TO BE ENTITLED
AN ACT


To amend Article 1 of Chapter 27 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions relative to a lottery for education, so as to change certain provisions relating to definitions; to change certain provisions relating to prize proceeds subject to state income tax, attachments, garnishments, or executions, validation of winning tickets, prohibited purchases, money-dispensing machines, and unclaimed prize money; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 27 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions relative to a lottery for education, is amended in Code Section 50-27-3, relating to definitions, by revising paragraph (19) as follows:
"(19) 'Operating expenses' means all costs of doing business, including, but not limited to, prizes that have been validly claimed, commissions, and other compensation paid to retailers, advertising and marketing costs, personnel costs, capital costs, depreciation of property and equipment, funds for compulsive gambling education and treatment, amounts held in or paid from a fidelity fund pursuant to Code Section 50-27-19, and other operating costs. Such term shall not include unclaimed prizes."

SECTION 2.
Said article is further amended in Code Section 50-27-24, relating to prize proceeds subject to state income tax, attachments, garnishments, or executions, validation of winning tickets, prohibited purchases, money-dispensing machines, and unclaimed prize money, by revising subsection (h) as follows:
"(h) Unclaimed prize money shall not constitute net lottery proceeds and shall be subject to the provisions of paragraph (1) of subsection (b) of Code Section 50-27-13. A portion of unclaimed prize money, not to exceed $200,000.00 annually, shall be directed to the
Department of Behavioral Health and Developmental Disabilities for the treatment of compulsive gambling disorder and educational programs related to such disorder. In addition, unclaimed prize money may be added to the pool from which future prizes are to be awarded or used for special prize promotions."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
