A BILL TO BE ENTITLED
AN ACT


To amend Article 2 of Chapter 2 of Title 32 of the Official Code of Georgia Annotated, relating to the State Transportation Board, so as to provide that a member of the State Transportation Board who seeks to qualify for elective office shall first resign from the board; to provide for the creation of a vacancy upon such member qualifying for elective office; to amend Chapter 1 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions regarding state government, so as to provide that members of state boards or authorities who seek to qualify for elective office shall first resign from such board or authority; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 2 of Title 32 of the Official Code of Georgia Annotated, relating to the State Transportation Board, is amended by revising Code Section 32-2-20, relating to composition of board, qualifications of members, terms of office, manner of selection of members, filling of vacancies, officers, meetings, and compensation of members, by adding a new subsection to read as follows:
"(b.1) Any member of the board who desires to seek elective office during such member's term of office on the board shall first resign from membership on the board prior to qualifying to seek such elective office; otherwise, such member's seat on the board shall be deemed vacated by operation of law upon such member qualifying to seek elective office."

SECTION 2.
Chapter 1 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions regarding state government, is amended by adding a new Code section to read as follows:
"50-1-10.
(a) Any member of a state board or authority who desires to seek elective office during such member's term of office on such board or authority shall first resign from membership on such board or authority prior to qualifying to seek such elective office; otherwise, such member's seat on such board or authority shall be deemed vacated by operation of law upon such member qualifying to seek elective office.
(b) The provisions of this Code section shall not apply to members of state boards or authorities who are subject to the provisions of Article II, Section II, Paragraph V, of the Georgia Constitution."

SECTION 3.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
