A BILL FOR AN ACT

 

 

relating to historic preservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that Hawaii's unique historic heritage is an irreplaceable asset to the State.  The preservation and enhancement of this valuable resource helps attract visitors, in addition to the State's beautiful climate, environment, and people.  The preservation of historic buildings, documents, photographs, and sites instills a distinct pride in the people of Hawaii and serves as a reminder of the uniqueness of Hawaii and its culture.  Accordingly, it is necessary to sustain, preserve, restore, and enhance historic treasures that represent the heritage and legacy of the people of Hawaii.

     The purpose of this Act is to establish a funding mechanism to assist in the preservation, restoration, and long-term sustainability of the Bernice Pauahi Bishop Museum, Iolani Palace, Washington Place, Royal Mausoleum at Mauna Ala, No. 1 Capitol District Building, and the state capitol.

     SECTION 2.  Section 103-8.5, Hawaii Revised Statutes, is amended by amending subsections (b) and (c) to read as follows:

     "(b)  The works of art special fund shall be used solely for the following purposes:

     (1)  Costs related to the acquisition of works of art, including any consultant or staff services required to carry out the art in public places and relocatable works of art programs;

     (2)  Site modifications, display, and interpretive work necessary for the exhibition of works of art;

     (3)  Upkeep services, including maintenance, repair, and restoration of works of art;

     (4)  Storing and transporting works of art[.]; and

     (5)  Costs related to preventive maintenance, repair, rehabilitation, or restoration of the Bernice Pauahi Bishop Museum, Iolani Palace, Washington Place, Royal Mausoleum at Mauna Ala, No. 1 Capitol District Building, and the state capitol to a condition reflecting their status in Hawaii's history and the unique heritage of the State's arts and culture; provided that:

         (A)  The preventive maintenance, repair, rehabilitation, or restoration project shall not change the design, material, or outer appearance of the property or change the characteristics that qualified the property for entry in the Hawaii register of historic places; and

         (B)  Moneys shall be expended for purposes of this paragraph only if moneys in the works of art special fund exceed $      , pursuant to subsection (c).

     (c)  The one per cent amount, which is included in all capital improvement appropriations, shall be calculated at the time the appropriation bills are signed into law.  The moneys shall be transferred into the works of art special fund upon availability of moneys from the appropriations.  Each agency receiving capital improvement appropriations shall calculate the one per cent amount and transfer the moneys into the works of art special fund.

     If moneys in the works of art special fund exceed $     in any fiscal year, any moneys in excess of $     , but not more than $     , shall be expended for the purposes of subsection (b)(5).  The comptroller shall consult with appropriate departments and organizations in deciding upon specific projects to undertake."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2015.
