A BILL FOR AN ACT

 

 

RELATING TO PUBLIC UTILITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of agriculture shall establish a working group to study the feasibility of excluding any person who provides water solely to agricultural activities from the definition of "public utility" as used in chapter 269, Hawaii Revised Statutes.

     (b)  The working group membership shall include:

     (1)  One representative from the office of Hawaiian affairs;

     (2)  One representative from the Hawaii Farm Bureau Federation;

     (3)  One representative from the Hawaii Farmers Union United;

     (4)  Three individuals who use water from a private water operator for agricultural activities; and

     (5)  At least one private water operator who provides water for agricultural activities.

     (c)  The working group shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2016.

     (d)  The members of the working group shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (e)  The working group shall be dissolved on June 30, 2016.

     SECTION 2.  This Act shall take effect upon its approval.
