A BILL FOR AN ACT

 

 

RELATING TO AFTER-SCHOOL PROGRAMS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that many schools restrict or prohibit department of education employees from distributing information on community-sponsored after-school programs.  These restrictions and policies serve to isolate schools and conflict with the goal that each school be an integral part of its community.

     The purpose of this Act is to allow for the reasonable promotion of community-sponsored after-school programs by department of education employees.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§302A-   Community-sponsored after-school programs; promotion.  An employee of the department of education may voluntarily promote a community-sponsored after-school program by making announcements, posting notices, and communicating information about the after-school program; provided that:

     (1)  The after-school program and the promotional efforts have been approved by the principal;

     (2)  The promotion does not impose an unreasonable added workload on the employee; and

     (3)  The promotion does not violate any policy of the board or any provision of part II of chapter 84.

     (b)  Notwithstanding any other law to the contrary, no employee of the department of education shall be liable for any claim arising out of the employee's promotion of a community-sponsored after-school program pursuant to this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2051.
