A BILL FOR AN ACT


 

 

RELATING TO ENERGY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that more than 90 per cent of Hawaii's energy comes from imported oil, and more than 60 per cent of oil is consumed for transportation purposes, including air transportation.  However, due to the pressing need to reduce air pollution, improve energy efficiency in transportation, and reduce the State's dependence on fossil fuels, significant steps must be taken to employ transportation alternatives.  Therefore, the legislature finds that it is in the best interest of the State to encourage the use of electric-powered motor vehicles within the state.  Increased usage of electric-powered motor vehicles would address such concerns.

     In 2007, the legislature passed a bill requiring the reduction of greenhouse gas emissions in the state, by January 1, 2020, to levels at or below emissions for 1990 (Act 234, Session Laws of Hawaii 2007).  Establishing a policy to require increased usage of electric-powered motor vehicles would push us further on the path to achieving this goal.

     In the same year the greenhouse gas emissions policy was passed, the legislature also required the Hawaii Energy Policy Forum (Forum) to conduct a study on energy-efficient transportation strategies in conjunction with the department of business, economic development, and tourism (Act 254, Session Laws of Hawaii 2007).  The study found that the increase in demand for transportation fuels over the past 20 years can be attributed to growth in the number of vehicles and the population.  Other information included in the study support, and should be considered in, the establishment of a policy requiring the increased usage of electric-powered motor vehicles.  Moreover, the Forum's experience in putting together the study, combined with its base knowledge and expertise, make the Forum an appropriate entity to develop a regulatory scheme to implement the policy.

     Thus, the purpose of this Act is to:

     (1)  Require 25 per cent of all consumer motor vehicles to be electric-powered by January 1, 2020; and

     (2)  Require the Hawaii Energy Policy Forum to develop a regulatory scheme to implement this policy.

     SECTION 2.  Declaration of policy.  By January 1, 2020, 25 per cent of all consumer motor vehicles in the state shall be electric-powered.

     SECTION 3.  Regulatory scheme.  (a)  Before 2012, the Hawaii energy policy forum shall develop a regulatory scheme to implement the policy in section 2 of this Act requiring that 25 per cent of all consumer motor vehicles be electric-powered by January 1, 2020.

     (b)  All state and county agencies, including the department of transportation, department of business, economic development, and tourism, department of health, and department of the attorney general, shall assist the Hawaii energy policy forum, upon its request, to develop the regulatory scheme.

     SECTION 4.  Report.  The Hawaii energy policy forum shall submit to the legislature:

     (1)  At least 20 days prior to the convening of the regular session of 2011, a preliminary report of its progress in developing the regulatory scheme; and

     (2)  At least 20 days prior to the convening of the regular session of 2012, a final report, including the proposed regulatory scheme and necessary legislation.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $      or so much thereof as may be necessary for fiscal year 2009-2010 for the Hawaii energy policy forum to develop a regulatory scheme to implement the policy requiring that 25 per cent of all consumer motor vehicles be electric-powered by January 1, 2020.

     The sum appropriated shall be expended by the University of Hawaii social science public policy center for the purposes of this Act.

     SECTION 6.  This Act shall take effect on July 1, 2009.
