A BILL FOR AN ACT

 

 

RELATING TO HIGHER EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     Section 1.  The legislature finds that the University of Hawaii system currently has a backlog of deferred repair and maintenance projects totaling over $480,000,000.  Simply complying with building code and health and safety requirements across all campuses of the University of Hawaii system will cost over $38,000,000 in fiscal year 2014-2015.  These costs do not include the additional $50,000,000 to $60,000,000 in repair and maintenance costs necessary to maintain all of the university campuses yearly.

     The legislature further finds that eighty-five thousand students use facilities at university campuses system-wide.  It is essential to the future of the University of Hawaii and its students and faculty that a safe and proper learning environment be provided and maintained.

     The legislature declares that the backlog of deferred repair and maintenance projects of the University of Hawaii system is a matter of statewide concern and therefore subject to the purview of the legislature pursuant to article X, section 6, of the Hawaii State Constitution.  Accordingly, the purpose of this Act is to establish a means to manage the funding of necessary repair and maintenance projects at University of Hawaii campuses statewide.

     SECTION 2.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part VI, to be appropriately designated and to read:

     "§304A-    Campus facility board; established.  (a)  There is established within the University of Hawaii a campus facility board that shall consist of the following members: chancellors from each campus of the university or the chancellor's designee, the chairperson of the University of Hawaii board of regents standing committee on budget and finance, and the chairperson of the University of Hawaii board of regents standing committee on planning and facilities.

     (b)  The chair of the campus facility board shall be selected by and from among its members.

     (c)  The campus facility board shall evaluate and identify all amounts appropriated by the legislature for repair and maintenance and shall evaluate, identify, prioritize, and allocate moneys from the amounts appropriated by the legislature to fund repair and maintenance projects of the university statewide.

     (d)  The campus facility board shall submit to the legislature, no later than twenty days prior to the convening of each regular session, a report that includes:

     (1)  The total amount of funds budgeted for repair and maintenance;

     (2)  The total amount of funds spent on repair and maintenance;

     (3)  An evaluation and inventory of any deferred maintenance backlog;

     (4)  A schedule showing all repair and maintenance project expenses by project, including all work in progress, as applicable;

     (5)  A schedule showing all projects completed in the previous year, including the final cost for each completed project;

     (6)  An updated list detailing all remaining repair and maintenance projects on all university campuses statewide;

     (7)  A report, which shall also be submitted to the University of Hawaii office of internal audit, detailing all projects over $5,000,000 that were delayed or experienced cost overruns; and

     (8)  The overall state of campus facilities."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
