A BILL FOR AN ACT
RELATING TO MEDICINE AND SURGERY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§453- Visiting sports physician temporary license. (a) The board may issue a visiting sports physician temporary license to a physician or osteopathic physician who is not licensed in this State. A person holding a visiting sports physician temporary license shall be authorized to provide medical care to members and coaching staff of a sports team or qualifying professional athletic association who are in the State for a specific sporting event located in the State. A visiting sports physician temporary license issued pursuant to this section shall be valid for the period of time requested by the applicant, which shall include the period of the sporting event; provided that in no case shall a visiting sports physician temporary license be valid for more than thirty days.
(b) To receive a visiting sports physician temporary license, the applicant shall:
(1) Complete and submit an application as prescribed by the board at least thirty days prior to the first day of the period of temporary licensure requested pursuant to subsection (a); provided that the board may waive the thirty day advance application requirement upon request and a showing of good cause;
(2) Provide proof that the applicant is licensed as a physician in another state or country or as an osteopathic physician in another state and that license is current and in good standing;
(3) Provide proof that the applicant has a written agreement with:
(A) A sports team that is sanctioned by or is a member of an association or organization of athletic teams that engage in professional, intercollegiate, or interscholastic athletic competitions; or
(B) A professional athletic association in which participation in association athletic competitions is limited to association members,
for the purpose of providing medical care in the State to members or coaching staff of the sports team or professional athletic association; and
(4) Pay all applicable fees.
(c) A person holding a visiting sports physician temporary license shall not:
(1) Provide care or consultation to any person residing in this State other than persons described in subsection (a) or as otherwise provided by state law;
(2) Practice at a health care clinic or health care facility in the State, including an acute care facility; or
(3) Open or appoint a place to meet patients or receive calls from patients relating to the practice of medicine beyond the parameters of subsection (a).
(d) A person holding a visiting sports physician temporary license shall obey all laws and rules of this State."
SECTION 2. (a) The auditor shall conduct a study to determine whether licensure for visiting sports physicians is warranted. The study shall include:
(1) A determination of whether licensure is necessary;
(2) Alternative forms of regulation other than licensure;
(3) The cost impact on the State requiring licensure of visiting sports physicians; and
(4) Any other issues deemed necessary or relevant by the auditor.
(b) The auditor shall submit a written report of findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2017.
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2112.
