A BILL FOR AN ACT

 

 

relating to the uniform commercial code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 490:2-316, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  Words or conduct relevant to the creation of an express warranty and words or conduct tending to negate or limit warranty shall be construed wherever reasonable as consistent with each other; [but subject] provided that:

    (a)   Subject to the provisions of this article on parol or extrinsic evidence (section 490:2-202), negation or limitation is inoperative to the extent that such construction is unreasonable[.]; and

    (b)   To exclude or modify the express warranty in a consumer contract, the language shall be printed in bold type at the beginning of the record of warranty."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
