A BILL FOR AN ACT

 

 

relating to AVIATION SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the impending rollout of fifth-generation cellular technology, or 5G, poses a serious threat to aviation safety within the State.  The legislature further finds that while 5G has been deployed near or around airports in foreign countries, the rollout of 5G in the United States is different because the 5G signal strength in this country is estimated to be twice the signal spectrum strength of 5G currently implemented in foreign countries.  The legislature also finds that Hawaii is critically dependent upon air travel to support the visitor industry, which is the number one economic driver in the State; provide for the critical transportation of goods and services between islands for the economy and the basic quality of life that Hawaii citizens need in a multi-island state; and for business activities and necessary medical care.

     The legislature finds that although the overall use of 5G and airplane activity are within the realm of the federal government, it is properly within the State's purview to regulate the installation of telecommunication technologies that may pose a hazard near or around state airports and as such, the legislature may regulate the installation of 5G near these facilities to protect the health and safety of the public and the vitality of the air transportation industry in so far as people and cargo go.

     The purpose of this Act is to prohibit the installation of wireless facilities and any modified or replaced utility poles used for the collocation of small wireless facilities that use fifth-generation cellular network technology within a certain radius of state airports and navigational equipment.

     SECTION 2.  Chapter 206N, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§206N-    Fifth-generation cellular network technology; prohibited.  (a)  Notwithstanding any law to the contrary, wireless facilities and any modified or replaced utility poles used for the collocation of small wireless facilities that use fifth-generation cellular network technology shall be prohibited from being installed or deployed within a certain radius, to be determined by the department of transportation in conjunction with the Air Line Pilots Association, International, of a state airport and navigational equipment.

     (b)  The department of transportation shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
