A BILL FOR AN ACT

 

 

RELATING TO DRIVING WHILE INTOXICATED.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The director of transportation shall convene an intoxicated driving reduction working group, under the leadership of Hawaii's strategic highway safety plan, to discuss, study, examine, and recommend transformative changes to the State's existing laws relating to the operation of a vehicle while under the influence of an intoxicant to reduce incidents of intoxicated driving.

     (b)  The working group shall consist of the following members or their designees:

     (1)  The director of transportation, who shall serve as the chair of the working group;

     (2)  A prosecutor from each county;

     (3)  A public defender from each county;

     (4)  The chair of the house standing committee on transportation;

     (5)  The chair of the senate standing committee on transportation; and

     (6)  A representative of law enforcement.

     (c)  The chair of the working group shall invite any other person that the chair deems relevant to the purposes of the working group.

     (d)  Members of the working group shall serve without compensation and may conduct meetings remotely to carry out the purposes of the working group.

     (e)  The working group shall discuss, study, and examine:

     (1)  The role of sobriety checkpoints in high-traffic areas;

     (2)  Strategies and best practices for implementing and utilizing sobriety checkpoints;

     (3)  Routine saturation patrols;

     (4)  The impact of reducing a person's permissible blood alcohol level while operating a vehicle from .08 per cent to .05 per cent; and

     (5)  Means of attracting additional law enforcement to sobriety checkpoints and saturation patrols.

     (f)  In conducting its work, the working group shall:

     (1)  Conduct informational meetings throughout the State with community stakeholders;

     (2)  Convene meetings to develop recommendations to better coordinate and improve the protection of pedestrians and motorists in the State; and

     (3)  Identify best practices and methods to sustain effective enforcement of state laws prohibiting the operation of a vehicle while under the influence of an intoxicant.

     (g)  The department of transportation shall submit to the legislature:

     (1)  The updated strategic highway safety plan with an outline of policy recommendations to combat intoxicated driving no later than December 31, 2024; and

     (2)  The strategic highway safety plan action plan with an outline of policy recommendations to combat intoxicated driving no later than December 31, 2025.

     (h)  The working group shall cease to exist on June 30, 2026.

     SECTION 2.  This Act shall take effect on July 1, 3000.
