A BILL FOR AN ACT

 

 

relating to Occupational safety and health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 396, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§396-     Crowd management safety plans.  (a)  Every employer that conducts events at which large crowds are expected to gather, such as retail sales events and concerts, shall adopt a crowd management safety plan that prepares employees to conduct the event in a manner that ensures the safety and well-being of the employees and people attending the event.  A crowd management safety plan shall include but not be limited to:

     (1)  Training employees in crowd management;

     (2)  Determining when trained security personnel or police officers should be hired for the event to maintain order and protect the employees and people attending the event;

     (3)  Equipment that may be needed, such as barricades, to safely manage and protect a crowd entering a building or designated area, to prevent undue rushing, pushing, or unruly behavior;

     (4)  Signage to inform people of the location of entrances and exits;

     (5)  Safety measures to accommodate people with disabilities;

     (6)  Allowing only a limited number of people at a time to enter a building or designated area so that the building or area does not exceed its maximum occupancy limit;

     (7)  Communicating with fire and police agencies before the event to determine whether all public safety requirements are met; and

     (8)  Designating specific employees to be responsible for notifying emergency personnel, when emergency personnel are needed.

     (b)  Failure of an employer to comply with the requirements of this section shall constitute a violation that is subject to the penalties established under section 396-10.

     (c)  The department of labor and industrial relations shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 2.  The department of labor and industrial relations shall submit a report to the legislature no later than twenty days prior to the convening of the 2013 regular session on the department's progress in adopting the rules required under this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
