A BILL FOR AN ACT
relating to land exchange.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
PART I
SECTION 1. The legislature finds that in December of 2012, the State purchased 1,750 acres of agricultural land in central Oahu. Surrounding these lands are approximately twenty thousand acres of agricultural and conservation lands owned by Dole Food Company, Inc. These lands have been listed for sale at $175,000,000.
The legislature further finds that there is a continuing need to protect and preserve unique natural assets, both for the enjoyment of future generations and to establish base lines for environmental impact. The present system of preserves, sanctuaries, and refuges must be strengthened, and additional areas of land suitable for agriculture and preservation should be set aside. These additional areas of land may contain rare species of plants and animals, portions of the State's major watershed areas, and prime agricultural lands.
The purpose of this part is to identify state-owned parcels of land to exchange for certain parcels of conservation and agricultural land currently owned by Dole Food Company, Inc.
SECTION 2. (a) The board of land and natural resources shall exchange the following parcels of land under its jurisdiction located on the island of Oahu identified by tax map keys 91016120, 91016179, 91016180, 91016181, 91017094, 91017095, 91017096, 91017106, 91017107, 91017110, 91017111, and 91151001, and acquire through exchange certain lands located on the island of Oahu and owned by Dole Food Company, Inc., identified as tax map keys 6-1-02-01, 6-1-02-23, 6-1-02-24, 6-2-02-02, 6-2-02-04, 6-2-02-23, 6-2-05-02, 6-2-05-35, 6-2-06-01, 6-2-06-06, 6-2-07-02, 6-2-07-04, 6-2-07-07, 6-2-07-08, 6-2-07-11, 6-2-10-06, 6-2-11-20, 6-3-01-02, 6-3-01-03, 6-3-01-05, 6-4-01-01, 6-4-01-04, 6‑4-01-05, 6-4-01-12, 6-4-02-01, 6-4-03-01, 6-4-03-03, 6-4-04-01, 6-4-04-06, 6-4-04-08, 6-5-01-14, 6-5-01-44, 6-5-01-46, 6-5-02-06, 6-5-02-07, 6-5-02-08, 6-5-02-11, 6-5-02-18, 6-5-02-19, 6‑5-02-23, 6-5-05-02, 6-5-05-03, 6-5-05-04, 6-6-10-10, 6-6-12-01, 6-6-14-04, 6-6-22-01, 6-6-23-03, 6-6-24-01, 6-6-25-01, 6-6-25-02, 6-6-25-06, 6-6-27-08, 6-6-27-09, 6-6-27-10, 6-7-01-05, 6‑7-01-08, 6-7-01-26, 6-7-01-30, 6-7-01-34, 6-7-01-37, 6-7-01-63, 6-7-02-14, 6-7-02-35, 6-7-02-36, 6-7-02-46, 6-7-03-02, 6-7-03-06, 6-7-03-07, 6-7-04-01, 6-7-04-04, 6-7-09-03, 6-7-13-07, 6‑8-02-05, 6-8-03-09, 6-8-06-17, 6-8-07-05, 7-1-02-06, 7-1-02-23, 7-1-02-34, 7-1-02-35, 7-1-02-36, 7-2-01-03, and 7-4-012-016.
(b) In this exchange between the State and Dole Food Company, Inc., the acreage of land need not be equal; provided that the value of state lands calculated at highest and best use shall be equal to the value of lands exchanged.
PART II
SECTION 3. Chapter 206E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§206E- East Kapolei community development district; established. The east Kapolei community development district is established. The district shall include parcels of land identified by tax map keys 91016120, 91016179, 91016180, 91016181, 91017094, 91017095, 91017096, 91017106, 91017107, 91017110, 91017111, and 91151001."
PART III
SECTION 4. The purpose of this part is to establish within the state treasury a special fund to be known as the Whitmore project facility revenue bond special fund into which the proceeds of revenue bonds shall be deposited for purchasing certain parcels of land from Dole Food Company, Inc.
SECTION 5. Chapter 163D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§163D- Whitmore project facility revenue bond special fund. (a) There is established within the state treasury a special fund to be known as the Whitmore project facility revenue bond special fund, which shall be administered by the corporation and into which shall be deposited the proceeds of the revenue bonds secured under the same trust indenture; provided that the total amount of moneys in the fund shall not exceed $ at the end of any fiscal year.
(b) Moneys in the Whitmore project facility revenue bond special fund shall be expended by the corporation for the acquisition of lands from Dole Food Company, Inc., as identified in section 40 of Act 134, Session Laws of Hawaii 2013."
SECTION 6. There is appropriated out of the Whitmore project facility revenue bond special fund the sum of $ or so much thereof as may be necessary for fiscal year 2014-2015 to acquire certain lands from Dole Food Company, Inc., as identified in section 40 of Act 134, Session Laws of Hawaii 2013.
The sum appropriated shall be expended by the agribusiness development corporation for the purposes of this Act.
PART IV
SECTION 7. New statutory material is underscored.
SECTION 8. This Act shall take effect on July 1, 2014.
