A BILL FOR AN ACT

 

 

RELATING TO NOISE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that vehicular noise pollution caused by excessive noise from commercial vehicles can have adverse impacts on human health and can also affect the quality of life in communities.

     Accordingly, the purpose of this Act is to establish noise pollution control measures on commercial vehicles that make pickups from, or deliveries to, business establishments during certain times of the day and within a certain proximity of single-family residences in the performance of the vehicles' pickup or delivery.

     SECTION 2.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XII to be appropriately designated and to read as follows:

     "§291C-     Noise; commercial vehicles; penalties.  (a)  Notwithstanding any law to the contrary, no person shall operate any commercial vehicle for the purpose of making a pickup from, or delivery to, a business establishment, where:

     (1)  The pickup or delivery is made between the hours of 10:00 p.m. and 7:00 a.m. on any day; and

     (2)  The commercial vehicle, while traveling on a roadway, parking lot, or other property owned or under the control of a business establishment, passes within fifty feet of any single-family residence in the performance of the pickup from, or delivery to, the business establishment.

     (b)  Any person violating this section shall be fined $200.

     (c)  All fines collected under this section shall be deposited into the state highway fund."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
