A BILL FOR AN ACT

 

 

RELATING TO HISTORIC PRESERVATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§6E-     Archaeological permit special account.  (a)  There shall be a special account within the Hawaii historic preservation special fund to be known as the archaeological permit special account and to which shall be credited all archaeological permit fees collected.

     (b)  Moneys credited to the special account shall first be used to cover the administrative and operational costs of managing the archaeological permit system.  Moneys remaining after disbursement shall be expended as provided in section 6E-16(b).

     (c)  The department shall adopt rules in accordance with chapter 91 for the purposes of this section."

     SECTION 2.  (a)  The board of land and natural resources shall amend any appropriate administrative rules to:

     (1)  Increase archaeological permit fees:

          (A)  From the current rate of $50 to $500 for the period from January 1, 2012, to December 31, 2012; and

          (B)  From $500 to $1,000 beginning on January 1, 2013,

          and

     (2)  Specify that the permit fees are to be deposited into the archaeological permit special account established under section 6E- , Hawaii Revised Statutes;

provided that persons who conduct archaeological activities for strictly educational purposes or community benefit shall be exempted from increases in the permit fee.

     (b)  The board of land and natural resources shall adopt rules pursuant to chapter 91 to carry out the purposes of this section.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2011.

Description:

Establishes a special account within the Hawaii Historic Preservation Special Fund and requires that archaeological permit fees collected be deposited into the account to cover the costs of managing the permits.  Directs the Department of Land and Natural Resources to increase permit fees over time.  (HB224 HD1)
