A BILL FOR AN ACT

 

 

relating to feral chicken control.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the feral chicken population in the State has grown to an unacceptable level.  Feral chickens have established themselves in communities throughout the State.  These chickens create nuisances and health hazards, particularly in suburban and urban communities, by trespassing in yards and gardens, digging in the ground, damaging food crops, and jeopardizing native plants.  The proliferation of feral chickens also makes roads unsafe for motorists who must suddenly brake or swerve to avoid an accident.

     The legislature further finds that unsanitary droppings from these birds are a health concern.  Feral chickens carry diseases that pose a threat to native Hawaiian birds.  Feral chickens may also spread diseases to domestic fowl and other wild birds.  Moreover, feral roosters crow at all hours of the day and night, leading to numerous noise complaints throughout the State.

     The purpose of this Act is to appropriate funds to the department of health to control the State's feral chicken population.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2023-2024 and the same sum or so much thereof as may be necessary for fiscal year 2024-2025 for the department of health to control the State's feral chicken population, by establishing and publicizing a feral chicken complaint hotline that members of the public may call to report nuisances and health hazards caused by the presence of feral chickens and to request removal of the feral chickens; provided that the department of health may contract with eligible nonprofit entities or for-profit entities to carry out the purposes of this Act.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2023.
